STUDIO94 Terms, Policies & Service Guidelines

Welcome to STUDIO94. These Terms, Policies & Service Guidelines explain how we handle bookings, payments, creative services, project timelines, revisions, deliverables, usage rights, cancellations, and general client responsibilities.

By booking a service, submitting an inquiry, paying an invoice, signing a proposal, approving a quote, participating in a project, or using our website, you agree to the policies listed below.

1. About STUDIO94

STUDIO94 provides creative media services including, but not limited to:

  • Videography

  • Photography

  • Graphic design

  • Brand visuals

  • Commercial content

  • Event coverage

  • Wedding media

  • Real estate media

  • Music videos

  • Social media content

  • Promotional materials

  • Digital and print design

  • Creative consulting

Services may vary depending on project type, availability, location, and client needs.

2. Service Inquiries

Submitting an inquiry does not guarantee availability, booking, pricing, or project acceptance.

STUDIO94 may request additional information before providing a quote, proposal, or service recommendation.

We reserve the right to decline projects that are outside our service scope, unavailable dates, creative direction, timeline, budget, location, or business policies.

3. Quotes and Estimates

All quotes and estimates are based on the information provided by the client at the time of inquiry.

Pricing may change if project details change, including but not limited to:

  • Project scope

  • Shoot location

  • Event timeline

  • Number of deliverables

  • Revision needs

  • Turnaround time

  • Equipment requirements

  • Travel requirements

  • Licensing needs

  • Additional editing

  • Additional design versions

  • Added services or requested upgrades

Quotes are not final until confirmed in writing by STUDIO94.

Unless otherwise stated, quotes are valid for 14 days from the date issued.

4. Booking and Retainers

A project, session, event, or service date is not officially booked until STUDIO94 confirms the booking and any required retainer, deposit, or signed agreement has been received.

Verbal conversations, text messages, emails, or inquiries do not reserve a date.

For date-specific services such as weddings, events, real estate shoots, or productions, dates are booked on a first-confirmed basis.

5. Payments

Payment terms will be listed on the invoice, quote, proposal, or service agreement.

STUDIO94 may require a retainer, deposit, partial payment, or full payment before work begins.

Unless otherwise agreed in writing, final payment may be required before final files, completed edits, designs, galleries, videos, or deliverables are released.

Accepted payment methods may vary and will be provided at the time of invoicing.

6. Late Payments

Invoices must be paid by the due date listed on the invoice.

Late or unpaid invoices may result in:

  • Delayed project delivery

  • Paused editing or design work

  • Withheld final files

  • Loss of priority scheduling

  • Additional late fees, if applicable

  • Cancellation of remaining services

STUDIO94 is not responsible for delays caused by unpaid invoices.

7. Deposits and Retainers

Deposits and retainers are used to reserve time, prepare for the project, and decline other potential bookings for that date or time period.

Unless otherwise stated in writing, retainers and deposits are non-refundable.

A deposit or retainer may be transferable to another date only if STUDIO94 approves the change in writing and availability allows.

8. Cancellations

Client cancellations must be submitted in writing.

Cancellation terms may vary depending on the service type, project size, timeline, and amount of work already completed.

If a client cancels after planning, production, editing, design, or project preparation has started, the client may still be responsible for costs related to completed work, preparation time, expenses, or booked time.

STUDIO94 is not required to refund work already completed or time already reserved.

9. Rescheduling

Rescheduling is subject to STUDIO94 availability.

For date-specific services, STUDIO94 cannot guarantee that a new date will be available.

Rescheduling may result in additional fees if it causes:

  • Additional travel

  • Additional planning

  • Venue changes

  • Timeline changes

  • Lost booking opportunities

  • Rush scheduling

  • Vendor coordination changes

  • Increased production costs

Weather-related rescheduling will be handled case-by-case.

10. Client No-Show or Late Arrival

If a client does not show up, is unavailable, or is significantly late for a scheduled session, shoot, consultation, meeting, or project time, the service may be shortened, rescheduled with a fee, or considered forfeited.

STUDIO94 is not responsible for lost production time caused by client lateness, lack of preparation, missing participants, venue delays, access issues, or incomplete project information.

11. Project Scope

Each project includes only the services, deliverables, and details agreed upon in writing.

Anything not listed in the approved quote, invoice, proposal, contract, or written agreement is not automatically included.

Additional requests may require additional fees.

Examples of extra services may include:

  • Additional shoot time

  • Additional edited photos

  • Additional video edits

  • Extra design versions

  • Rush delivery

  • Raw footage

  • Drone footage

  • Additional locations

  • Extra revisions

  • Printing costs

  • Special formatting

  • Social media cutdowns

  • Commercial licensing

  • Expanded usage rights

  • Travel or accommodation costs

12. Revisions

Revision terms vary by project type.

Unless otherwise stated in writing, projects may include a limited number of reasonable revisions.

Revisions are intended for small adjustments, not complete redesigns, full re-edits, major concept changes, or changes caused by unclear direction from the client.

Additional revisions may require an additional fee.

STUDIO94 reserves the right to determine whether a requested change is a revision or a new/additional service request.

13. Client Approval

The client is responsible for reviewing proofs, drafts, edits, designs, videos, photos, copy, and project materials carefully.

Once a project is approved, any changes requested afterward may require additional fees.

STUDIO94 is not responsible for errors, misspellings, incorrect dates, incorrect names, wrong information, or design issues that were approved by the client before final delivery, print, posting, or publishing.

Read that twice. Approval means approval.

14. Turnaround Times

Turnaround times vary depending on project type, project size, editing needs, workload, season, client response time, and payment status.

Estimated timelines are not guaranteed unless specifically stated in writing.

Delays may occur due to:

  • Client response delays

  • Late payments

  • Missing information

  • Revision requests

  • Weather

  • Venue restrictions

  • Technical issues

  • File transfer issues

  • Production complexity

  • Schedule changes

  • Emergency circumstances

Rush delivery may be available for an additional fee.

15. Rush Orders

Rush orders are not guaranteed and must be approved by STUDIO94.

Rush fees may apply when a client requests delivery faster than the standard timeline.

Rush pricing depends on project type, deadline, workload, and whether other scheduled work must be moved to accommodate the request.

16. Final Deliverables

Final deliverables will be provided in the format agreed upon for the project.

Deliverables may include digital files, galleries, edited videos, graphics, print-ready files, web files, social media files, or other approved formats.

Unless otherwise stated in writing, STUDIO94 is not required to provide:

  • Raw footage

  • RAW photo files

  • Project files

  • Layered design files

  • Editable source files

  • Unedited galleries

  • Audio stems

  • Timeline files

  • Working files

  • Alternate versions not included in the original scope

Working files remain the property of STUDIO94 unless specifically purchased or released in writing.

17. Raw Files and Source Files

Raw files, source files, unedited images, project files, layered design files, and working files are not automatically included with any service.

If available, these files may be purchased or licensed separately at STUDIO94’s discretion.

STUDIO94 reserves the right to decline release of raw files or source files.

18. File Storage

STUDIO94 makes reasonable efforts to store completed project files for a limited time after delivery.

However, long-term storage is not guaranteed unless agreed upon in writing.

Clients are responsible for downloading, saving, and backing up their final files after delivery.

STUDIO94 is not responsible for lost files after delivery has been completed.

19. Client-Provided Materials

The client is responsible for ensuring they have the legal right to use any materials they provide to STUDIO94, including:

  • Logos

  • Photos

  • Videos

  • Music

  • Fonts

  • Copy

  • Graphics

  • Brand assets

  • Product images

  • Trademarks

  • Third-party content

The client agrees not to provide materials that violate copyright, trademark, privacy rights, licensing agreements, or other legal restrictions.

STUDIO94 is not responsible for legal issues caused by client-provided materials.

20. Music Licensing

For video projects, music may be selected from licensed music libraries, royalty-free platforms, or approved sources.

Clients may request certain music styles or moods, but specific songs are not guaranteed unless licensing rights are legally available and approved.

Popular commercial songs may require additional licensing and may not be included without proper permission.

STUDIO94 is not responsible for social media muting, takedowns, copyright claims, or platform restrictions caused by music requested or provided by the client.

21. Copyright and Ownership

Unless otherwise agreed in writing, STUDIO94 retains copyright and ownership of all original creative work produced by STUDIO94, including photos, videos, designs, edits, concepts, layouts, and working files.

Upon full payment, the client receives usage rights for the final approved deliverables according to the agreed project purpose.

Ownership of final files does not automatically include ownership of raw files, source files, unused concepts, rejected drafts, project files, or behind-the-scenes work.

22. Usage Rights

Usage rights depend on the type of project and the agreement between STUDIO94 and the client.

Unless otherwise stated in writing, client usage is limited to the intended purpose discussed at the time of booking.

Expanded usage may require additional licensing, especially for:

  • Paid advertising

  • Commercial campaigns

  • Television

  • Streaming platforms

  • Large-scale print distribution

  • Merchandise

  • Resale

  • Third-party licensing

  • National or international campaigns

If the client needs expanded commercial usage, this must be discussed before final delivery.

23. Portfolio and Marketing Use

Unless otherwise agreed in writing, STUDIO94 may use completed work, behind-the-scenes content, project images, videos, designs, testimonials, and approved final deliverables for portfolio, website, social media, advertising, promotional, and marketing purposes.

If a project is private, confidential, unreleased, or sensitive, the client must notify STUDIO94 in writing before the project begins.

24. Confidential Projects

STUDIO94 respects confidential projects when confidentiality is agreed upon in writing.

If a client requires non-disclosure, limited sharing, or delayed posting, this must be discussed before work begins.

Additional confidentiality requirements may require a separate written agreement.

25. Event, Wedding, and Production Limitations

For live events, weddings, performances, and productions, STUDIO94 makes every reasonable effort to capture important moments.

However, STUDIO94 cannot guarantee coverage of moments that are missed due to circumstances outside our control, including:

  • Timeline delays

  • Venue restrictions

  • Poor lighting

  • Audio restrictions

  • Weather

  • Guest interference

  • Blocked camera views

  • Vendor delays

  • Last-minute changes

  • Lack of access

  • Equipment restrictions

  • Client failure to provide schedule details

STUDIO94 is not responsible for missed moments caused by conditions outside our control.

26. Drone Services

Drone services are subject to weather, location, airspace restrictions, safety conditions, property permissions, local rules, and pilot discretion.

Drone footage is never guaranteed unless specifically approved and conditions allow.

STUDIO94 reserves the right to cancel or decline drone operation for safety, legal, weather, or location-related reasons.

27. Travel and Location Fees

Travel fees may apply for projects outside STUDIO94’s standard service area.

Travel-related costs may include:

  • Mileage

  • Fuel

  • Tolls

  • Parking

  • Lodging

  • Meals

  • Venue access

  • Permits

  • Equipment transport

  • Additional travel time

Travel fees will be quoted based on project location and requirements.

28. Permits, Venue Rules, and Access

The client is responsible for notifying STUDIO94 of any venue rules, permits, access requirements, photography restrictions, filming restrictions, drone restrictions, insurance requirements, parking rules, or vendor policies.

The client is responsible for obtaining approvals, permissions, access, and permits unless otherwise agreed in writing.

If STUDIO94 cannot complete work due to lack of access, missing permissions, venue restrictions, or incorrect client information, refunds are not guaranteed.

29. Printing and Third-Party Vendors

For print or production projects, STUDIO94 may prepare files for printing, but final print quality may vary depending on the printer, material, paper, ink, color calibration, and production method.

STUDIO94 is not responsible for errors caused by third-party printers, vendors, manufacturers, shipping companies, platforms, or outside service providers.

Clients are responsible for reviewing and approving all final print files before production.

30. Website, Social Media, and Digital Platform Use

If STUDIO94 creates content for websites, social media, email campaigns, ads, or digital platforms, the client is responsible for ensuring the content follows the platform’s rules, advertising policies, account requirements, and usage restrictions.

STUDIO94 is not responsible for platform changes, account restrictions, algorithm performance, ad rejections, copyright claims, or third-party platform issues.

31. Performance Disclaimer

STUDIO94 provides creative services but does not guarantee specific business results.

We do not guarantee:

  • Sales

  • Views

  • Followers

  • Engagement

  • Bookings

  • Leads

  • Viral performance

  • Search rankings

  • Ad results

  • Revenue increases

Creative work can support marketing, branding, and presentation, but results depend on many factors outside STUDIO94’s control.

32. Communication

Clients are expected to communicate clearly and in a timely manner.

Project delays caused by slow responses, missing details, unclear feedback, late approvals, or incomplete materials may affect delivery timelines.

STUDIO94 may pause a project if required information, payment, feedback, or approval is not provided.

33. Professional Conduct

STUDIO94 reserves the right to refuse, pause, or cancel services if a client engages in abusive, threatening, harassing, discriminatory, unsafe, or inappropriate behavior.

Respect is required on both sides. Creative work is collaborative, not a cage fight.

34. Refunds

Refunds are handled case-by-case and depend on the service, payment type, project stage, and amount of work already completed.

Completed work, reserved dates, deposits, retainers, design time, editing time, production time, consultations, and delivered files are generally non-refundable.

Refunds are not guaranteed for client dissatisfaction caused by changes in preference, unclear direction, approved work, missed deadlines caused by the client, or requests outside the agreed project scope.

35. Chargebacks and Payment Disputes

Clients agree to contact STUDIO94 directly to resolve any payment concern before filing a chargeback or payment dispute.

Filing a chargeback for completed, delivered, or approved work may result in collection action, cancellation of future services, loss of access to final files, and additional administrative fees where allowed.

36. Errors and Corrections

If STUDIO94 makes an error, we will make reasonable efforts to correct it.

If the error was caused by incorrect information provided by the client, client approval, third-party vendor issues, or changes requested after approval, additional fees may apply.

37. Limitation of Liability

STUDIO94’s liability is limited to the amount paid by the client for the specific service related to the claim.

STUDIO94 is not liable for indirect, incidental, special, consequential, or business-related damages, including lost profits, lost opportunities, lost data, platform restrictions, or third-party issues.

38. Force Majeure

STUDIO94 is not responsible for failure or delay caused by circumstances beyond our reasonable control, including but not limited to:

  • Severe weather

  • Natural disasters

  • Illness

  • Accidents

  • Power outages

  • Internet outages

  • Equipment failure

  • Venue restrictions

  • Government actions

  • Emergencies

  • Acts of God

  • Road closures

  • Safety concerns

When possible, STUDIO94 will make reasonable efforts to reschedule or provide an alternative solution.

39. Policy Changes

STUDIO94 may update these policies at any time.

The most current version will be posted on our website.

Continued use of our services or website means you accept the current policies.

8. Children and Minors

STUDIO94 does not knowingly collect personal information directly from children under 13 through our website without appropriate parent, guardian, school, or authorized adult involvement.

For projects involving minors, including school events, youth sports, family sessions, performances, contests, or student-related media, STUDIO94 expects the booking party, parent, guardian, school, organization, or event host to obtain any required permissions, consents, releases, or approvals before photography or videography begins.

STUDIO94 may provide photography, videography, design, media coverage, promotional content, event coverage, sports media, graduation media, classroom content, school marketing content, and other creative services for schools, school-related events, student programs, youth organizations, and educational environments.

Because school projects may involve students, minors, staff, faculty, private information, and school property, this policy explains how STUDIO94 handles school-related photography and videography.

1. Purpose of This Policy

This policy is designed to protect STUDIO94, schools, students, parents, guardians, staff, and clients by clearly outlining expectations for school-related photography and videography services.

This policy applies when STUDIO94 is hired, invited, contracted, approved, or requested to capture media at:

2. School Authorization Required

STUDIO94 will only provide photography or videography services on school property or at school-sponsored activities when authorized by the school, school representative, event organizer, parent, guardian, or approved client.

The booking party is responsible for confirming that STUDIO94 has permission to be present and provide media services at the location or event.

STUDIO94 may request written approval, a point of contact, campus instructions, vendor requirements, or documentation before arriving on campus.

3. Parent, Guardian, and Student Consent

For projects involving minors, the school, parent, guardian, organization, or booking party is responsible for obtaining all required permissions, consent forms, media releases, photo releases, video releases, and approvals before the shoot or event.

STUDIO94 does not assume responsibility for collecting consent from every student, parent, guardian, staff member, or attendee unless specifically agreed in writing.

If certain students may not be photographed or filmed, the school or booking party must notify STUDIO94 in writing before the project begins and provide a clear process to identify those individuals.

4. Students Who Cannot Be Photographed or Filmed

If a student, parent, guardian, or school has requested that a student not be photographed or filmed, the school or booking party must inform STUDIO94 before the shoot or event.

The school or booking party is responsible for helping STUDIO94 identify restricted students in a respectful and practical way.

This may include:

  • Providing a staff contact to assist during the event

  • Giving seating or location guidance

STUDIO94 will make reasonable efforts to avoid photographing or filming restricted students when clearly notified and properly assisted.

However, for large events, crowds, performances, sports, graduations, assemblies, or public-facing activities, STUDIO94 cannot guarantee that every person will be completely excluded from all background footage unless the school provides proper planning, placement, and supervision.

5. Compliance With School Policies

The school or booking party is responsible for informing STUDIO94 of all applicable campus policies, district policies, safety rules, check-in procedures, visitor requirements, media rules, privacy restrictions, and event guidelines.

This may include:

  • Campus check-in procedures

  • Visitor badges

  • Background check requirements

  • Vendor requirements

  • Insurance requirements

  • Restricted areas

  • Student privacy rules

  • Media release procedures

  • Staff escort requirements

  • Classroom filming rules

  • Audio recording restrictions

  • Parking instructions

  • Emergency procedures

  • Drone restrictions

  • Security requirements

STUDIO94 agrees to follow reasonable school rules and safety procedures once they are clearly provided.

6. Privacy and Student Information

STUDIO94 will make reasonable efforts to respect student privacy during school-related projects.

STUDIO94 will not intentionally collect sensitive student information such as student records, grades, disciplinary information, medical information, addresses, identification numbers, or private educational records.

If any private student information appears in a photo or video by accident, such as papers, screens, rosters, badges, or documents, STUDIO94 may crop, blur, remove, or avoid using that content when reasonably possible.

The school or booking party is responsible for preventing access to private student records or confidential materials during the shoot.

7. FERPA and Education Record Considerations

STUDIO94 understands that some photos or videos involving students may be subject to school privacy rules or education record rules depending on how the school uses, stores, maintains, or identifies the media.

The school or educational institution is responsible for determining whether specific media is considered an education record, directory information, protected student information, or otherwise restricted under applicable laws, policies, or district rules.

STUDIO94 will follow written instructions provided by the school regarding restricted content, student privacy, delivery requirements, and approved use.

8. COPPA and Online Use Involving Children

STUDIO94 does not knowingly collect personal information directly from children under 13 through online forms, websites, or digital services without appropriate adult, parent, guardian, school, or organizational authorization.

If a school-related project involves children under 13, the school, parent, guardian, or booking party is responsible for ensuring proper consent and authorization before student information, photos, videos, names, or other identifying details are submitted, published, or shared.

9. Use of Student Names and Identifying Information

STUDIO94 will not intentionally publish a student’s full name, personal contact information, address, phone number, email, student ID, grade information, medical information, or private records without appropriate permission.

If student names, team names, graduation names, roster details, captions, award titles, or identifying information are requested, the school or booking party is responsible for confirming that the information is accurate and approved for public use.

STUDIO94 is not responsible for incorrect, unapproved, or restricted student information provided by the school, parent, guardian, or client.

10. School Marketing and Promotional Use

If STUDIO94 is hired to create promotional, marketing, recruitment, website, social media, advertisement, or public-facing content for a school, the school is responsible for confirming that all individuals shown have the appropriate permissions or releases required by the school, district, organization, or applicable law.

STUDIO94 may use approved final work for its own portfolio, website, social media, or promotional purposes unless the school or client requests written restrictions before the project begins.

For school projects involving minors, STUDIO94 may limit portfolio use or request written approval before posting.

11. Public Events and Crowd Coverage

At school events that are open to families, guests, spectators, or the public, STUDIO94 may capture crowd footage, wide shots, event atmosphere, performances, sports, awards, and general activity.

The school or event organizer is responsible for notifying attendees of photography or videography when required by school policy.

STUDIO94 is not responsible for individual attendees who attend public or semi-public events and appear incidentally in crowd shots, background footage, or event coverage, unless specific restrictions are provided in writing before the event.

12. Classroom and Private Learning Spaces

Classroom filming, interviews, small group student features, or private student activities require extra care.

Before filming or photographing in classrooms or similar private learning spaces, the school or booking party must confirm:

  • Permission from the school

  • Permission from the teacher or staff member

  • Any required parent or guardian releases

  • Any students who cannot be photographed or filmed

  • Any privacy-sensitive areas or materials

  • Any content that should not be captured

STUDIO94 reserves the right to stop filming or photography if privacy concerns arise.

13. Audio Recording

School video projects may involve audio recording, including interviews, speeches, classroom audio, performances, announcements, ceremonies, or event sound.

The school or booking party is responsible for confirming that audio recording is allowed and that any required consent has been obtained.

STUDIO94 may choose not to record audio in certain school environments if privacy, safety, or consent concerns exist.

14. Interviews and Testimonials

Student interviews, testimonials, teacher interviews, staff interviews, parent interviews, or on-camera statements must be approved by the school or booking party.

For minors, parent or guardian consent may be required before conducting or publishing interviews.

STUDIO94 may request written confirmation before filming interviews involving students.

15. Sports, Performances, and Live Events

STUDIO94 may provide coverage for school sports, performances, games, competitions, concerts, theater productions, award ceremonies, graduations, and other live events.

The school or event organizer is responsible for confirming access, credentials, media areas, field/court/stage restrictions, performance rights, music restrictions, and any student privacy rules.

STUDIO94 will make reasonable efforts to capture important moments but cannot guarantee coverage of every participant, student, play, performance, award, or moment.

16. Delivery of School Media

Final photos, videos, galleries, designs, or media files will be delivered according to the project agreement.

STUDIO94 may deliver files to the school, organization, parent, guardian, or approved client.

The receiving party is responsible for how files are shared, posted, distributed, printed, stored, archived, or used after delivery.

STUDIO94 is not responsible for unauthorized sharing or misuse by the school, client, parents, students, staff, or third parties after files have been delivered.

17. File Storage and Removal Requests

STUDIO94 may store school-related media for a limited period after delivery.

Long-term storage is not guaranteed unless agreed in writing.

A school, parent, guardian, or authorized representative may request that certain content be reviewed, removed, blurred, cropped, or withheld from public STUDIO94 portfolio use.

STUDIO94 will make reasonable efforts to honor valid privacy-related requests when possible.

STUDIO94 cannot guarantee removal of content already downloaded, shared, reposted, printed, published, or distributed by third parties.

18. Social Media Posting

STUDIO94 may post approved school-related content to its website, portfolio, or social media unless restricted in writing before the project begins.

For student-related projects, STUDIO94 may request approval from the school or booking party before posting.

The school or booking party is responsible for confirming whether content may be posted publicly.

If a parent, guardian, school, or authorized representative requests that a specific student-related post be removed, STUDIO94 will review the request and make reasonable efforts to respond appropriately.

19. Restricted Content

STUDIO94 may refuse to capture, publish, deliver, or use content that appears unsafe, inappropriate, private, exploitative, misleading, or harmful to a student, school, staff member, or minor.

STUDIO94 may also avoid or remove content involving:

  • Student injury

  • Medical emergencies

  • Discipline issues

  • Bullying

  • Fights

  • Emotional distress

  • Private student records

  • Sensitive personal information

  • Wardrobe malfunctions

  • Unsafe behavior

  • Restricted students

  • Any content the school identifies as private or inappropriate

20. Drone Use on School Property

Drone photography or videography on or near school property is subject to strict safety, weather, airspace, school, district, property, and legal restrictions.

Drone use is never guaranteed.

Drone operation may require:

  • School approval

  • Property owner permission

  • Airspace approval

  • Weather approval

  • Safety clearance

  • Distance from students or crowds

  • Compliance with applicable drone rules

STUDIO94 reserves the right to decline drone operation at any school-related project for safety, privacy, airspace, or legal reasons.

21. Client and School Responsibilities

The school, organization, parent, guardian, or booking party is responsible for:

  • Providing accurate project details

  • Obtaining required permissions

  • Confirming student media releases

  • Notifying STUDIO94 of restricted students

  • Providing campus access instructions

  • Providing event timelines

  • Providing parking details

  • Assigning a point of contact

  • Confirming venue and school rules

  • Confirming posting and usage permissions

  • Reviewing final materials before publication when required

  • Notifying STUDIO94 of privacy concerns as early as possible

STUDIO94 cannot be responsible for information that was not provided before the project.

22. No Guarantee of Individual Coverage

For large school events, performances, games, graduations, or ceremonies, STUDIO94 cannot guarantee that every student, participant, guest, teacher, staff member, graduate, athlete, performer, or award recipient will be photographed or filmed unless specifically agreed in writing.

Coverage depends on access, timing, visibility, crowd size, schedule, lighting, venue rules, and other conditions.

23. Safety

STUDIO94 reserves the right to stop, pause, relocate, or refuse photography or videography if safety concerns arise.

This includes unsafe crowd conditions, severe weather, restricted access, student safety concerns, security instructions, emergency situations, or any condition that makes production unsafe or inappropriate.

24. Use After Delivery

Once final media is delivered to the school, client, parent, guardian, or organization, that receiving party is responsible for how the media is used, shared, downloaded, posted, printed, distributed, or archived.

STUDIO94 is not responsible for misuse, reposting, screenshots, third-party sharing, platform issues, or unauthorized use after delivery.

25. Policy Updates

STUDIO94 may update this School Photography & Videography Policy at any time.

The most current version will be posted on our website.

Continued use of STUDIO94 services means you accept the current policy.

Donated Auction / Contest / Promotional Service Terms

Thank you for choosing STUDIO94. We are excited to work with you and honored that you participated in a silent auction, contest, fundraiser, or promotional event where a STUDIO94 service was offered as a complimentary donated service.

This agreement explains what is included, what is not included, and how complimentary services are handled.

1. Complimentary Service Acknowledgment

The client understands and agrees that this service was received through a silent auction, contest, fundraiser, giveaway, promotional event, or similar donated-service opportunity.

This means the core creative service listed in the original donated offer is provided at no charge to the winning bidder or selected recipient, subject to the terms listed in this agreement.

The complimentary service may include photography, videography, design, or another STUDIO94 service, depending on what was specifically donated or awarded.

2. What Is Included

The complimentary service includes only the specific service described in the original auction, contest, fundraiser, or promotional listing.

Unless otherwise stated in writing, the complimentary service includes:

  • The creative service awarded or donated

  • Standard planning communication

  • One initial consultation

  • Standard production or service time, as approved by STUDIO94

  • Standard editing or delivery for the awarded service

  • Final deliverables as determined by the donated package

The exact included deliverables will be confirmed during the initial consultation.

3. Local Service Area

Complimentary donated services are intended for clients located within the local service area of the auction, contest, fundraiser, or promotional event.

For this donated service, the local complimentary service area includes:

  • Lake City, Florida

  • Live Oak, Florida

  • Surrounding North Florida areas reasonably located near Lake City or Live Oak

STUDIO94 will determine whether a location falls within the complimentary local service area.

4. Out-of-Area Service Fee

If the requested service location is outside the local complimentary service area, the service itself may still remain complimentary, but additional costs may apply.

Out-of-area locations may require a service accommodation fee to cover travel time, mileage, fuel, tolls, lodging, meals, parking, permits, or other necessary expenses related to providing the service outside the standard local area.

A recommended minimum out-of-area service fee is:

$150 minimum for locations outside the local complimentary service area

Additional fees may apply depending on:

  • Distance from Lake City or Live Oak, Florida

  • Travel time

  • Fuel and mileage

  • Required lodging

  • Parking or venue access costs

  • Permit requirements

  • Length of service

  • Equipment needs

  • Schedule restrictions

  • Any special accommodations needed to complete the service

The final out-of-area service fee will be determined by a STUDIO94 representative after the initial consultation and before the service is officially scheduled.

The client will not be charged for the awarded creative service itself unless the client requests upgrades, add-ons, or services beyond the original complimentary offer.

5. Travel, Lodging, and Accommodation Costs

The complimentary service does not automatically include travel expenses, lodging, meals, parking, transportation, tolls, location fees, permit fees, or other accommodation costs.

If any of these expenses are required, they are the responsibility of the client unless STUDIO94 agrees otherwise in writing.

No out-of-area service will be scheduled or confirmed until all applicable service accommodation fees are approved by both parties.

6. Add-Ons, Upgrades, and Extra Services

The complimentary donated service only includes the original awarded service.

Additional services are not included unless approved in writing by STUDIO94.

Examples of additional services may include:

  • Extra hours of coverage

  • Additional edited videos

  • Additional edited photos

  • Rush delivery

  • Raw footage

  • Drone footage

  • Additional locations

  • Additional revisions

  • Printed products

  • Social media edits

  • Full ceremony edits

  • Full event edits

  • Additional design versions

  • Expanded commercial licensing

  • Any services not included in the original donated offer

Any requested add-ons or upgrades will be quoted separately and must be approved before work begins.

7. Scheduling

All complimentary services must be scheduled in advance and are subject to STUDIO94 availability.

Winning or receiving a complimentary service does not guarantee availability for any specific date.

Dates are not reserved until STUDIO94 confirms availability and all required information has been received.

For weddings, events, or date-specific services, the client should contact STUDIO94 as early as possible.

8. Expiration Date

Unless otherwise stated in writing, complimentary donated services must be redeemed within:

12 months from the date of the auction, contest, fundraiser, or promotional event.

Expired services may not be honored unless STUDIO94 chooses to extend the expiration date in writing.

9. Rescheduling

The client may request to reschedule, but all rescheduling is subject to STUDIO94 availability.

If the service requires travel, venue access, permits, or other accommodations, rescheduling may result in additional costs.

STUDIO94 is not responsible for venue changes, weather changes, event delays, cancellations, or client scheduling conflicts.

10. Cancellations and No-Shows

Because this is a complimentary donated service, no cash refund or cash value will be provided if the client cancels, does not show, fails to respond, or chooses not to redeem the service.

If the client fails to provide required details, fails to confirm the scheduled date, or is unavailable at the agreed service time, the complimentary service may be considered forfeited.

11. No Cash Value

Complimentary services have no cash value and may not be exchanged for cash, credit, refund, or unrelated services.

The service may not be transferred to another person unless approved by STUDIO94 in writing.

12. Client Responsibilities

The client agrees to provide all necessary information needed to complete the service, including but not limited to:

  • Full name

  • Contact information

  • Event or project date

  • Location

  • Timeline

  • Service expectations

  • Venue rules

  • Access details

  • Parking information

  • Required permissions

  • Any important creative direction

The client is responsible for making sure STUDIO94 has permission to work at the location or venue.

13. Venue Rules, Permits, and Restrictions

The client is responsible for informing STUDIO94 of any venue rules, photography/video restrictions, vendor requirements, insurance requirements, parking rules, drone restrictions, permit requirements, or access limitations.

If a venue, property owner, city, county, or other authority requires a permit, pass, fee, approval, or special access, the client is responsible for those costs unless otherwise agreed in writing.

14. Creative Control

STUDIO94 will make every effort to create high-quality work that reflects the client’s needs and the nature of the donated service.

However, STUDIO94 retains creative discretion over shooting style, editing style, final selections, music selection, pacing, color treatment, design decisions, and final presentation unless specific terms are agreed upon in writing before the project begins.

15. Delivery Timeline

Delivery timelines vary depending on the type of service, project size, season, workload, and editing requirements.

Estimated delivery timelines will be discussed during the consultation.

Complimentary services may not qualify for rush delivery unless rush delivery is added as a paid upgrade.

16. Revisions

If revisions are included, they will be limited to reasonable adjustments within the scope of the original donated service.

Major changes, re-edits, redesigns, additional versions, or requests outside the original scope may require an additional fee.

17. Usage Rights

Unless otherwise agreed in writing, STUDIO94 may use photos, videos, graphics, behind-the-scenes content, finished edits, or project materials for portfolio, website, social media, marketing, advertising, and promotional purposes.

If privacy is a concern, the client must notify STUDIO94 in writing before the service date or before the project begins.

18. Limitations

STUDIO94 is not responsible for circumstances outside of its control, including but not limited to:

  • Weather

  • Venue restrictions

  • Poor lighting conditions

  • Audio restrictions

  • Guest interference

  • Timeline delays

  • Missed moments caused by schedule changes

  • Equipment restrictions imposed by the venue

  • Lack of access to required areas

  • Client's failure to provide accurate details

STUDIO94 will make a professional effort to adapt when possible, but cannot guarantee coverage of moments that are missed due to conditions outside of its control. Anyone doing business with studio 94 or has services done by this brand is legally bound to all policies and contracts listed here on this website and in any kind of contracts physical or digital, and understands that STUDIO94™ is not held responsible for any unforeseen situations out of our control and do not hold STUDIO94™ responsible and cannot ever try to sue or take STUDIO94™ to court because you understand this.
